General Data Protection Regulation - Buy-To-Let Landlords

By 25th May 2018 all landlords need to ensure their business is compliant with GDPR.

It does not matter how many properties you let, if you collect any data about your tenants, then you must comply with GDPR.

Landlord registration with ICO is a statutory requirement.

In addition to this we would recommend landlords will need to:

1. Distinguish the type of data you hold - personal data and sensitive personal data.
2. Audit how tenants’ personal data flows in and out of your business and how it is disposed of.
3. Check with third parties you share information with to make sure they are GDPR compliant.
4. Prepare a privacy notice to provide to tenants.
5. Develop a data protection policy that sets out how tenants’ details are stored.
6. Keep good records.
7. Consider law enforcement for HMO’s, immigration Right to Rent checks, HMRC investigations, etc.

If you are not prepared, you could face severe fines and liability for compensation.
